These terms and conditions (“Terms and Conditions”) apply to and form part of every contract between you (“Customer”) and Squaregrapes. No Terms and Conditions which the Customer may seek to impose and/or variations of these conditions shall have any effect to this contract. These Terms and Conditions govern your use of the Squaregrapes website and your relationship with Squaregrapes (company registration number 12758373, (the “Company”, “we” or “us”). We recommend reading the terms and condition carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, we recommend you do not register for or use the website. ORDERING
I. Orders on our website are placed by clicking the ‘confirm order’ button. or via the telephone.
II. By placing your order, you agree to use our services and comply with our terms and conditions
III. Email confirmation will be sent to you once your payment has been received. This confirmation email will be sent by an automated serve. Please ensure you check your junk box. Ensure our email correspondence is directed to your inbox so that you receive any other communications related to your order effectively
PAYMENT
Squaregrapes accepts payment by credit card (Visa, MasterCard), debit card (Electron, Delta, Maestro, Switch), or charge card (American Express).
Validation checks are subjected to all credit and charge card transactions by the card issuer. For additional protection against a fraud, Squaregrapes may (but is not obliged to) carry out extra checks on the names and addresses given in the order process against commercially available records such as Electoral Roll data.
If necessary we may contact you again to verify details before we carry out the a delivery of the products ordered. In this situation, Squaregrapes will not be held responsible for any delay or inconvenience caused.
CONTRACT
A legally binding contract will exist between you and the Company, at the point your payment is received by us. However Squaregrapes reserves the right to refuse or amend any order up to the point of dispatch. We describe below your right to cancellation.
By registering on our website, and placing any order for alcoholic beverages through the website or by phone, you confirm that you are over 18 in line with our services policy. Anyone under the age of 18 attempting to order or receive delivery of alcoholic beverages will be in breach of our terms and conditions. With immediate effect, the contract between you and us is void. Our drivers are instructed that if they are in doubt about age of the person receiving the delivery, they should not deliver the product and the sale will be cancelled.
We will always contact you if due to unforeseen circumstances we have to amend before proceeding with the sale.
AVAILABILITY
Squaregrapes is committed to do its utmost to ensure that all products offered on the website are currently available. However availability can be limited, particularly with products from small-scale producers that we offer. All our products are offered subject to availability.
PRICING AND DISCOUNTS
Unless otherwise stated, prices include duty and VAT and are quoted in pounds sterling. Prices are given per bottle (75cl for wine, 70cl for spirits) or as otherwise listed. Our website display the standard bottle price followed by a discounted price for case quantities or any special offer.
Whereas we make every effort to ensure availability of the products offered and correct pricing, mistakes can occur. In the event of a product being accidentally offered at an incorrect price, Squaregrapes reserve the right to refuse to supply at the incorrect price. You will be contacted to ascertain whether you would like to proceed with the order at the correct product price.
Discounted prices apply to a minimum quantity of one case of wine or spirits (Six or twelve bottles or equivalent), that may be mixed in any combination across our range, subject to a single delivery address.
Time-limited offer, at any given date is subject to availability and dates are for guidance purposes only. Squaregrapes reserves the right to change any price or offer without notice and will not be obliged to fulfil orders up to given date.
DELIVERY
Delivery of the Product shall be made by the courier delivering the Product to the customer address or other place agreed by Squaregrapes and the Customer. Squaregrapes will be not liable for any theft or damage to the Product if the agreed place is not safe or secure for the keeping of the product. This will be at the Customer’s own risk.
Deliveries are subject to delivery charges except where the value of the products delivered to a single address (in the UK mainland) is equal to or exceeds the sum defined by the company in which case the products will be delivered free of charge.
Claims related to discrepancy, breakage or any other defect or any other issue must be notified to us or any third-party courier immediately during the delivery.
If the customer fails to receive delivery of the products and fails to give the company adequate instructions then the customer shall be liable for the failed delivery charges, insurance of the Product, and costs of storage.
Any delivery dates and times stated are for guidance only and Squaregrapes shall not be liable for any delay in delivery of the Product, however caused.
The delivery documents shall be signed for by the customer and any discrepancies should be reported immediately Delivery documents not signed for will be deemed as accepted by the customer.
Upon receipt of the products the customer shall inspect the Product. The products will be deemed accepted as delivered and in fulfilment of the orders placed, unless you contact us within three days of collection or delivery, and you will not be entitled to reject products thereafter except as defined below.
ORDER CANCELLATIONS, RETURNS, BREAKAGES
You have the right to cancel orders delivered to you within seven days of receipt if the returned products comply with the conditions set below:
I. The products were delivered incorrectly by to the customer. This should be reported to the company within 3 working days of delivery.
II. Returned products must be presented in full and in its original boxes.
III. Bottles must be returned in a sellable condition and bottle labels must not be stained or damaged.
IV. The company reserves the right to reject the return of products, or to credit the value of any returned products, that are not in a sellable condition.
V. Any claims related to breakages will only be allowed if the company is notified immediately. The product breakages and its packaging must be kept for examination
VI. Collection fee will be payable to any product that we have collected from your postal address or any agreed location. If the products are not in sellable condition we reserve the right to return the product to you and a re-delivery fee will also be payable.
VII. Upon receipt and acceptance by us we will refund all payments (less any collection or delivery charges) within 30 days.
SPECIAL TERMS
You will be notified regarding any special terms before you confirm any order. Placing an order following such notification will constitute acceptance of any special terms we have notified you of.
FORCE MAJEURE
Squaregrapes is not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.
SEVERANCE
Any of these Terms and Conditions which is or may be void or unenforceable shall to the extent of such invalidity or unenforceability be deemed severable and shall not affect any other Term or Conditions.
